Jury Interviews and such...

Well, let me put up an exemplar blog by using a jury experience. I get called to jury duty a fair amount, have served including being the foreman, but that was an exception because I was the only person left in the jury pool... normally I'm 'tossed' at the first opportunity.


Here is a hint, though for you attorneys about the wording you choose during jury interviews.

The attorney asked the group "Is there anyone here that believes that just because my client was arrested by the police and charged by the district attorney, that he might be considered to be more guilty of the crime he is charged with than any other person walking down the street, or you or I?"

OK, I understand that what he was getting at was presumption of innocense; but that isn't what he asked! What he asked was do I believe that his client could be more guilty than me (or any other person). While I presume him to be innocent under the law, I do suspect he might be guilty; certainly more guilty than me! To not suspect this would mean that I have lost all faith in law enforcement and their probable cause, and in the district attorney for reinforcing that by bringing charges. While I know there are breakdowns and sometimes abuse of the system, as a citizen I have to maintain some measure of reliance on that system. So, could his client be more guilty than the next guy, his attorney, or ME? Yeah. That doesn't mean I don't give him the benefit of the doubt; that I don't presume him innocent under the law; it just means that I have to have some faith in the fact that we're just dragging people into the courts willy-nilly. So like it or not, I'm going to assume that the guy could be more guilty than ME. Sorry, but that's just the way I am.

Oh yeah... I got tossed again!
